Ukraine – New Regulations for Data Cryptographic Protection Facilities

The Ukraine Cabinet of Ministers has recently issued a Resolution for the improvement of data cryptographic protection facilities in the country. The document is entitled “On the Approval of the Technical Regulations on Data Cryptographic Protection Facilities” and will officially take effect on January 1, 2022.

This Resolution requires all new facilities to comply with the new and enhanced requirements. Data cryptographic protection facilities that have already been in operation before the implementation of the Resolution are not exempted and they will also have to modify their systems to comply with the new standards. However, these older facilities will have until January 1, 2027 to make these changes.

There are two ways to confirm cryptographic protection. The first is through the validation of an expert in the area of cryptographic information protection. The second is by means of a compliance document. In Ukraine, the Administration of the State Service for Special Communications and Information Protection will be the validating entity to supervise the entry of new data cryptographic protection facilities in the state market.

This means that starting in January 2022, all new data cryptographic protection facilities that will be used anywhere in Ukraine or sold to the Ukrainian market will need to go through stringent quality control procedures supervised by a state expert. Only when they have passed these requirements can they be put into operation or sold in the market.
