Brazil’s National Telecommunications Agency (ANATEL) has launched Public Consultation Nº 36 to update requirements for Access Terminal Stations (ETA) and cellular mobile phones. This proposal restricts certification of new equipment operating solely on 3G or lower technologies for Personal Mobile Service (SMP) networks.

The rules stem from feedback on Subsidies No. 23/2023, aiming to accelerate the transition from 2G and 3G to 4G and 5G technologies.

Key Provisions

  1. Certification Restrictions:
    • Prohibits certification of 3G-only modules or products.
    • Requires VoLTE support for voice calls on new equipment.
  2. Exceptions for Automotive Industry:
    • Allows 3G-only technology for automotive spare parts with ANATEL’s authorization.
  3. Maintaining Existing Certifications:
    • Existing certifications remain valid without technical adjustments.
  4. Implementation Timeline:
    • Act effective 180 days post-publication.
