According to Resolution 715, Section VII outlines the grounds for the suspension and cancellation of Certificates of Conformity, particularly in Article 52 and Article 53. Some critical clauses include:
- Suspension Cases: Failure to comply with product standards, misuse of the certificate for marketing, or failure to maintain periodic certification can all result in suspension.
- Cancellation After 180 Days: If a certificate is suspended and the non-conformities are not addressed within 180 days, or if no valid justification is provided, the certificate must be canceled.
What Does This Mean for Certification Holders?
Although the regulation has existed since 2019, ANATEL had not strictly enforced it until now. Manufacturers and certification bodies need to be aware of this policy change. Moving forward, it will be crucial to stay ahead of certification deadlines and ensure all required documentation is submitted on time.
For certificates that have been expired for more than 180 days, companies must now submit a completely new project application. This process will include:
