Brazil – New ANATEL Act 14430: Preparing for 2G and 3G Shutdown

October 7, 2024, Brazil’s National Telecommunications Agency (ANATEL) issued Act No. 14430. This new standard is a significant step following Public Consultation No. 36/2024, and it establishes crucial changes for the future of mobile technology in Brazil. With the eventual shutdown of 2G and 3G networks looming, ANATEL is ensuring that new products will not be allowed to operate exclusively on these outdated technologies. The Act will come into force on April 6, 2025.

ANATEL Act No. 14430 is a new regulatory measure in Brazil aimed at phasing out legacy 2G and 3G mobile networks, making way for more advanced technologies like 4G and 5G. This decision, driven by the National Telecommunications Agency (ANATEL), aligns with global trends where countries are retiring older network generations to optimize resources for faster, more efficient mobile networks.

Some Aspects are below:

Key Requirements of Act 14430:

1. Additions to Act No. 3151:

  • 4.4: Certification of modules or final products classified as Personal Mobile Service Access Terminal Stations, which are compatible only with 3G or lower technologies, is not permitted.
  • 4.5: Modules or products that support voice calls must be capable of operating with VoLTE (Voice over LTE) technology, including emergency calls, and must support SMS over IMS (IP Multimedia Subsystem).

2. Additions to Act No. 3152:

  • 4.5: Certification of mobile phones compatible only with 3G or lower technologies is not permitted.
  • 4.6: Mobile phones must support voice calls using VoLTE, including emergency calls, and SMS over IMS.

3. Grandfathering Clause:

Equipment already certified and compatible only with 3G or lower technologies before April 6, 2025, can maintain their certifications without needing to comply with the new requirements.

This new regulation paves the way for more advanced mobile technology in Brazil, as the country prepares to phase out older networks. Manufacturers and service providers will need to ensure that new devices comply with these standards, particularly the requirement for VoLTE support for voice calls and emergency services.
