Peru - Type Approval Delays

Peru, new energy labeling requirements will gradually come into effect according to the Supreme Decree No. 009-2019-EM. Originally, the requirements established by Technical Regulation on the Energy Efficiency Labeling of Energy Using Equipment No. 009-2017-EM were to take effect on April 8, 2019.

According to the new Decree, a Certificate of Conformity (CoC) by a recognized certification body is required for the appliances on the dates listed in the chart below.

Tumble dryers for domestic use April 1, 2020
Instantaneous water heaters April 1, 2020
For ballasts and boilers where no Certification Office (CO) is established The effective date will be 360 days after the first Certification Body is accredited and published in the Peruvian official gazette

During the transition period, importers, distributors and/or sellers must ensure products are marked with the new energy label and meet the applicable annexes and Technical Regulations without the need to present a CoC. The products will remain subject to the respective inspection and sanctions in case of non-compliance with subsections i), ii) and iii) of section 12.2 of article 12 of the Technical Regulations approved by Supreme Decree No. 009-2017-EM. Importers, distributors and/or sellers may use national or international accredited or non-accredited testing laboratories to carry out the tests and/or evaluations necessary to report the information and comply with the Energy Efficiency Labeling requirements.
