On July 31, 2020, ANATEL issued 8 new regulations related to Resolution N° 715. The new resolutions will become in effect 180 days after their publication.
Descriptions of the main objectives are as follows:
Act 4077 – This operating procedure establishes the rules to be followed in the event of changes in technical
characteristics, design, in the version of the software or firmware of the product or manufacturing
process in a telecommunications product approved by Certification or by Declaration of Conformity,
which may affect the requirements technical or operational procedures under which the product has
been evaluated.
Act 4081 – This Procedure establishes the minimum conditions necessary for the designation of a Telecommunications Product Certification Body, in accordance with the provisions established in the Regulations for Conformity Assessment and Homologation of Telecommunications Products, approved by Resolution No. 715, of October 23, 2019.
Act 4082 – This operational procedure establishes the means of exercising rights and fulfilling obligations, as provided for in articles 19, 21 and 57 , §§1 and 2 of the Regulations for Conformity Assessment and Homologation of Telecommunications Products, approved by Resolution No. 715, of October 23, 2019, especially with regard to responsibilities and the relationship between Designated Certification Bodies, Testing Laboratories and Applicants for conformity assessment and approval.
Act 4083 – (Revokes Act 2220 in 180 days) This operational procedure establishes the rules and documents for the evaluation of product compliance for telecommunications in the Certification modality, as provided in the Regulations for Conformity Assessment and Homologation of Telecommunications Products, especially with regard to the evaluation process conducted by a Certification Body Designated (OCD) and the other agents involved in the process (Testing and Claimant Laboratories).
Act 4084 – (Revokes IG/06-v.02 in 180 days) This procedure establishes the conditions and minimum requirements necessary to obtain the approval of the Certificate of Conformity for telecommunications products.
Act 4085 – This Procedure establishes the minimum requirements necessary for the recognition of professionals as qualified persons to act in the evaluation of the conformity of products for telecommunications.
Act 4088 – (Revokes Act 2221 in 180 days) This Procedure establishes the guidelines for marking the identification of ANATEL homologation in telecommunications products.
Act 4091 – (Revokes IG/01-v.05 in 180 days) This Procedure establishes the conditions and minimum requirements necessary for the selection, evaluation and application for the qualification of a laboratory for testing telecommunications products.
