India – New E-Waste Management Rules 2022 for IT and AV Devices

On November 2, 2022, the Ministry of Environment, Forest and Climate Change of India issued The E-Waste (Management) Rules, 2022. The new rules will come into effect from April 1, 2023.

These rules shall apply to all businesses and individuals involved in manufacturing, sales, transfer, purchase, refurbishing, dismantling, recycling and processing of e-waste or electrical and electronic equipment. Newly targeted products include information technology and telecommunication equipment, tablets, iPads, consumer electrical and electronic equipment, electronic toys, electrical and electronic tools, and medical equipment.

Under the EPR regime, all manufacturers, producers, refurbishers and recyclers are required to register on portal developed by the Central Pollution Control Board (CPCB). The CPCB will conduct random sampling of electrical and electronic equipment placed in the market to monitor and verify compliance of reduced use of hazardous substances.
