“Protecting Against National Security Threats to the Communications Supply Chain Through the Equipment Authorization Program and the Competitive Bidding Program”

The FCC is currently examining new regulations for equipment certification, with the goal of ensuring that authorized equipment doesn’t include any “covered” components posing a security risk. They aim to devise methods for identifying these potentially risky components and improving the equipment authorization process to address potential threats from companies on the Covered List. The Commission is also considering the possible impact of these changes on the market and supply chain, as well as the implications of revoking existing authorizations for “covered” equipment.

They’re also exploring the treatment of modules and composite systems that may contain devices produced by entities on the Covered List. The FCC is seeking input on whether separate certifications should be required for these devices and how to guarantee they don’t pose any security risks. They are also looking into alternative approaches, such as replacing specific components or implementing security patches, instead of completely revoking authorizations.

The FCC is contemplating changes to how they revoke equipment authorizations and requests feedback on whether authorization holders should be provided due process protections. They are also seeking suggestions on effective enforcement mechanisms for these changes and how to educate the public about any revocations that may occur.

Moreover, the Commission is requesting input on potential supply chain disruptions and how to mitigate them, such as providing clear market signals and sufficient notice before banning authorized equipment. They are also considering the requirement of a U.S.-based responsible party for compliance and seeking input on the most effective way to implement this requirement.

Additionally, the FCC is asking for feedback on potential updates to their information-gathering and post-market surveillance procedures, as well as other actions to enforce the equipment authorization program’s rules related to “covered” equipment. They are also contemplating requiring applicants for Commission spectrum licenses to confirm that their bids do not rely on financial support from entities designated as national security threats.
