Malaysia NCEF New Communications Equipment Framework

The Malaysian Communications and Multimedia Commission (MCMC) has initiated a public consultation on the New Communications Equipment Framework (NCEF), a significant regulatory update aimed at addressing current gaps and challenges in the certification and importation of communications equipment in Malaysia. This consultation seeks the views and comments of industry stakeholders, interested parties, and the public.

Key Proposals in the NCEF

  1. Supplier and Equipment Registration: The NCEF proposes the registration of suppliers and communications equipment based on risk classifications—high-risk (Scheme A), medium-risk (Scheme B), and low-risk (Scheme C). Suppliers must register with MCMC and comply with specific conditions depending on their commercial or non-commercial status.
  2. Labelling Requirements: Registered communications equipment must bear a compliance mark approved by MCMC. This ensures consumers can identify certified equipment easily, promoting safety and quality assurance.
  3. IMEI and Serial Number Registration: Suppliers are required to register the International Mobile Equipment Identity (IMEI) or serial numbers of each unit before importation or market placement. This measure aims to enhance tracking and prevent the sale of uncertified devices.
  4. Enhanced E-Commerce Oversight: The framework includes provisions to regulate the sale of communications equipment on e-commerce platforms more effectively. This includes addressing the sale of uncertified equipment by overseas merchants who currently evade local regulatory oversight.
  5. Prohibition of Certain Equipment: The framework outlines specific categories of communications equipment that are prohibited from being manufactured, imported, or sold in Malaysia.
  6. Timeline and Transitional Arrangements: The proposed NCEF implementation timeline includes a six-month grace period post-gazettement and a subsequent six-month transition period. This phased approach aims to ensure smooth adaptation for all stakeholders.

Public Participation and Feedback

MCMC invites all stakeholders to provide their feedback on the proposed NCEF. The consultation paper details specific questions seeking public views on various aspects of the framework. Responses should be submitted by 12:00 noon on June 21, 2024, via email to stpd@mcmc.gov.my.
