Mexico – Changes For NOM Standards

Changes will come into effect on June 3, 2019 that will effect NOM Standards for telecom, safety and energy.

A summary of the main changes are as follows:

  • New HS Codes were listed as mandatory to comply with NOM Standards, either safety, telecom, etc.
  • Importers who previously chose to obtain a NOM, working with “exception letters”, will now be required to obtain a mandatory NOM.
  • Goods that were not sold to the general public or imported for manufacturing process, will now require a NOM.
  • Dictums on Highly Specialized devices will continue to be issued, however,  the Custom Agent will be able to check if such goods, imported under that scheme, are in fact, Highly Specialized Equipment, and will have the right to reject it, if it’s not the case.
  • NOM Certificates will again show the HS Code. Starting June 3rd, all current NOM certificates, even those that were issued in the past, will now need to show the HS Code, otherwise they will not be valid at Customs and importations cannot be carried out.
