Mexico – Open Consultation on Modification of IFT Conformity Assessment Procedure

On April 21, 2021, the Federal Institute of Telecommunications (IFT) issued a Public Consultation “Preliminary Draft Agreement by which the Plenary of the Federal Telecommunications Institute modifies the Procedure for the evaluation of conformity in matters of telecommunications and broadcasting”.

This public consultation is in response to concerns from manufacturers, stakeholders and interested persons in the telecommunications industry regarding the current Conformity Assessment Procedure (PEC), which came into force on February 25, 2021.

The main topics of the consultation are:

1. Define the requirements that the interested parties must meet, in order to include importers as persons who can make use of the corresponding Certificate of Conformity, i.e., allow certificates to be extended to importers.
2. Reduce the number of samples presented in each scheme, except in cases where the applicable technical provisions specifically indicate, the obligation to present more than one sample.
3. Establish that the Institute will have access to the technical information of the Test Reports, at any time that the authority so requires, in addition to modifying their validity to 90 days.
4. Establish that the extension of the Certificate of Conformity in the “Sample by Product Model and Surveillance for more than one Lot” scheme, (Scheme 2) would be subject to a documentary analysis, as well as the corresponding record of the additional lots that are requested to be expanded in a Certificate Compliance.
5. Introduce a series of procedures that allow the evaluation to be carried out of the conformity of used, second-hand, rebuilt, reconditioned or similar products, which comply with the applicable technical – regulatory framework under “Batch Certification” (Scheme 1).

It’s important to note that the full PEC Regulations are not under consultation, but only the indicated sections.

Duration
From April 21, 2021 to June 19, 2021 (60 calendar days). Once this consultative process has concluded, the Institute will not receive any further comments, opinions and contributions, as this process will be considered completed and closed.
