Reminder – UKCA Requirements Take Effect Soon

Product Security and Telecommunications Infrastructure (PSTI) Act

There are just 5 months remaining until the UKCA mark becomes the mandatory conformity assessment marking in Great Britain. Is your product compliant?

The UKCA mark must be used for placing goods on the GB market (England, Scotland and Wales), from January 1, 2023. The UKCA mark applies to most goods previously subject to the CE marking and came into effect on January 1, 2021.

In an effort to ease with the transition, the UK government plans to introduce new measures related to the UKCA marking, including the following:

  • UKCA mark can be added on a label affixed to the product or on a document accompanying the product until December 31, 2025.
  • continue the acceptance of spare parts that comply with the same assessment requirements that were in place at the time the original product or system they are intended to repair, replace or maintain was placed on the market. If the spare part has been modified or substantially changed, it must comply with the new GB requirements.
  • recognize completed conformity assessment activities (such as testing and certification) carried out under EU requirements before January 1, 2023, in order to declare UKCA compliance. Products must still bear UKCA mark and will need to undergo conformity assessment with a UK Approved Body at the expiration of the certificate or until December 31, 2027, whichever is sooner.
  • eliminate the need to re-test imported stock; CE marked products which have been imported into GB under contract before December 31, 2022 are considered as ‘placed on the GB market’ and do not need to undergo re-testing and re-certification to UKCA requirements.

In summary, any ‘new” product must comply with GB regulatory requirements, including the requirement for conformity assessment by a UK approved body from January 1, 2023. Important note, the UKCA mark is not recognized on the European market. Products need a CE Mark to be placed in the EU.
